Service Description

1. A “virtual card” is a unique MasterCard® or Visa® card number issued under your account. Unlike physical credit or debit cards, virtual cards do not have a physical plastic counterpart. Instead, they are issued with a unique card number, expiration date, and security code.
2. Virtual cards are issued for a limited-time use, with a specified amount and expiration period. They may be issued for a single transaction or multiple transactions (“multi-use”).
3. Upon your request for a virtual card, we will issue it electronically to you. You agree not to permit any third party to use your virtual card login credentials or request a virtual card on your behalf without our express prior consent. We will not be responsible for any financial loss caused by the transfer of credentials to third parties.
4. Virtual cards will typically be issued once we have received an authenticated instruction from you. However, we will not be liable for any system delays. Please allow sufficient time when requesting the issuance of virtual cards to accommodate such delays. We are not responsible for any late fees, consequences, or damages caused by untimely receipt of payment by any payee when using virtual cards.
5. You agree not to exceed the transaction limits we establish from time to time on your account or any card, including any virtual card.
6. You acknowledge that all fees and charges applicable to card transactions as defined in Fees will also apply to all card transactions made using a virtual card.
7. The virtual card balance can only be replenished through the CardsPro service or the Capitalist system. Any attempts to replenish the card by other means give us the right to restrict service. We are not responsible for the funds involved when using any other card top-up methods other than those specified in these Terms and Conditions. Refunds are not guaranteed but may be provided at Our discretion up to a maximum of 50% of the amount of funds involved in the transaction once the KYC process has been fully completed at Capitalist.

Use of Information

When Capitalist and CardsPro collects or discloses any information relating to you or any of your employees or other representatives, we will use this information in accordance with our terms and conditions and our Privacy Policy (available at https://capitalist.net/privacypolicy). If any of your representatives provide us with information on behalf of another individual, you confirm that they have the authority to do so and will provide that individual with a copy of our Privacy Policy.

Liability

1. Capitalist and CardsPro is not liable for any unauthorized or prohibited use of the virtual cards. Users are responsible for ensuring compliance with these terms and conditions and applicable laws and regulations.
2. Capitalist and CardsPro reserve the right to monitor transactions made by using virtual cards and take appropriate actions if illegal activity is suspected.
3. Overdraft and Financial Penalties: In instances where a card issued, or if any financial fines are imposed by payment systems or banks due to the actions of the cardholder, the user who issued the card shall be responsible for reimbursing the full amount of the overdraft, fines, and penalties. This amount will be directly debited from the user's associated account or will be refunded to Capitalist and CardsPro according to the procedures outlined in these Terms. We also reserve the right to take additional actions necessary to recover these or other amounts of any damages to Capitalist and CardsPro, including but not limited to, legal actions and restriction of service.

Prohibited Use of Cards

1. Gambling, lotteries, and bookmaking services;
2. Brokerage services;
3. Trading in derivative financial instruments;
4. Issuance and circulation of cryptocurrencies;
5. Activities of collection agencies;
6. Lending and loan services;
7. Freight forwarding services;
8. Network marketing, goods, services, internet content of a pornographic nature, and prostitution;
9. Tobacco products and alcoholic beverages;
10. Precious stones and products made from them, and waste containing precious and rare-earth metals and precious stones;
11. Acquisition and production of all types of weapons, ammunition, military equipment, regulatory documentation, research results, and other goods and services of militarized organizations and governmental/military/state institutions;
12. Toxic substances and means of protection against them, poisons, narcotics, and psychotropic substances, regulatory documentation for their production and use;
13. Uranium, other fissile materials, and products made from them;
14. X-ray equipment, instruments, and equipment using radioactive substances and isotopes, radioactive material waste;
15. Cryptographic equipment and regulatory-technical documentation for its production and use;
16. Explosive waste, medicines, raw materials, and dietary supplements;
17. Special and technical means for covert information acquisition, including registration, visual observation, documentation, wiretapping, interception, control, and inspection, as well as regulatory-technical documentation for them;
18. Radio-electronic means and other equipment for transmitting and receiving radio waves;
19. Databases containing personal data, and other goods and services, the sale of which is prohibited by the legislation of the country where the payment is made, goods, or services that negatively affect the business reputation of Capitalist;
20. Fraudulent activities, including but not limited to the manipulation of accounts and card blocking to avoid post-payment for advertising;
21. Drugs and potent substances.

Decline and/or refund rate above 15% will result in a warning and then partial/full disconnection of access to CardsPro services.

It is forbidden to use cards for mass activation of trial subscriptions in personal accounts of merchants with their subsequent non-payment.

Auto-registration and multi-accounting are prohibited in the CardsPro service. Access to accounts of CardsPro users who are suspected of auto-registration or multi-accounting may also be temporarily suspended or permanently cancelled.

Amendments

Capitalist and CardsPro reserves the right to amend these terms and conditions at any time without prior notice. Any changes will be effective immediately upon posting on our website. Continued use of the virtual cards constitutes acceptance of the amended terms.

Termination

You and Capitalist and CardsPro may terminate the contract incorporating these terms and conditions upon 14 days’ notice to the other party. The contract incorporating these terms and conditions will automatically terminate on termination of our agreement.
